1. Purpose and Acceptance
These Terms of Service (the “Terms”) govern access to and use of our online store and the purchase of products on hobbitalf.com. By using the website or making a purchase, you agree to these Terms and our Privacy Policy and Return Policy (linked in the footer). If you do not agree, please do not use the website.
2. Access, Account and Age
The contract is concluded in Spanish. You declare that you are over 18 years of age and that the information provided is truthful, complete, and up to date. You are responsible for maintaining the confidentiality of your credentials and for all activity carried out through your account.
3. Pre-Contractual Information and Purchase Process
Before completing your purchase, you will see a summary of your order (products, price, taxes, shipping costs). You may correct any errors in your shipping details and shopping cart before payment. After payment, you will receive a confirmation email with your order details. We retain records to comply with legal obligations, and you may request a copy of your confirmation.
4. Products, Availability and Prices
We display product descriptions and images as accurately as possible; however, they may differ due to screen settings. We reserve the right to update products, prices, promotions, and availability. Prices include VAT (unless otherwise stated) and exclude shipping costs, which are displayed before checkout.
5. Orders and Payment
Your order constitutes an offer to purchase, which is accepted once we confirm payment and send you the order confirmation. We may reject or cancel orders (e.g., due to lack of stock, unverifiable payment details, or obvious pricing errors). We accept the payment methods indicated on the website and may apply anti-fraud controls.
6. Shipping, Delivery and Transfer of Risk
We ship to the territories and within the timeframes indicated on the Shipping page. Delivery times are estimates.
Risk and title: In accordance with EU consumer regulations, the risk transfers to the consumer when the consumer takes physical possession of the order. If you choose a carrier other than the one proposed by us, the risk transfers upon delivery to that carrier. Any partial deliveries do not affect consumer rights. If an order is returned due to an incorrect address, absence, or refusal, we may charge re-shipping costs.
7. Returns, Exchanges and Refunds
These are governed by the Return Policy (link). For dog and cat food products, the legal exceptions to the right of withdrawal apply (Article 103 LGDCU) due to perishability and health and hygiene reasons if the seal has been broken. For incidents (damage/errors), you must notify us within 72 hours of delivery with photos and batch/date details; we will assess each case and may offer a replacement, store credit, or refund, and arrange collection where applicable.
8. Legal Warranty and Food Safety
You benefit from the legal conformity warranty rights provided by applicable regulations. For perishable products, shelf life is subject to the best-before/expiry date and proper storage. If you detect any lack of conformity or potential quality issue, please contact us.
9. Intellectual and Industrial Property
The content, trademarks, images, and designs of HOBBIT.ALF, S.L. or its third-party licensors are protected by intellectual and industrial property laws. Their use beyond what is strictly necessary for browsing and purchasing is not permitted without express authorization.
10. User Content (Reviews, Comments)
Any review or comment you publish must be truthful, lawful, and respectful. You grant us a non-exclusive, royalty-free license to use such content for site operation and promotion purposes. We may moderate or remove content that violates these Terms or applicable law.
11. Third-Party Tools and Links
We may provide third-party tools or links (e.g., payment gateways, embedded content). We do not control these sites and are not responsible for their content or operation. Please review their terms and policies before using them.
12. Relationship with Shopify
Our store operates using Shopify technology. Purchases are made directly with HOBBIT.ALF, S.L. Shopify is not a party to the sales contract between you and us.
13. Limitation of Liability
Nothing herein limits mandatory consumer rights. Without prejudice to the foregoing, and except in cases of willful misconduct, gross negligence, or liability that cannot legally be excluded, we shall not be liable for indirect losses (loss of profits, loss of opportunity, etc.) arising from the use of or inability to use the website.

15. Severability
If any provision is declared invalid, the remaining provisions shall remain in full force and effect.

17. Governing Law and Jurisdiction
These Terms are governed by Spanish law. In consumer matters, disputes shall be submitted to the Courts and Tribunals corresponding to the consumer’s place of residence. For non-consumer users, the parties submit to the Courts and Tribunals of Barcelona (Spain).
